1. Acceptance of Terms

By creating an account, accessing, or using SapioChat ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are creating an account on behalf of a minor, you represent and warrant that you are the child's parent or legal guardian and that you consent to these Terms on their behalf. If you do not agree to these Terms, you must not use the Service.

2. Service Description

SapioChat is an AI-powered conversational assistant designed for young people and families. Parents create and manage child accounts, configure age-appropriate safety policies and family guidance, and monitor flagged safety events. The AI provides educational, informational, and conversational responses shaped by these settings.

The Service is intended for personal, non-commercial family use. It is not a substitute for human instruction, professional guidance, or parental engagement.

3. AI Limitations and Disclaimer

Please read this section carefully. It describes the inherent limitations of the AI technology that powers SapioChat.

SapioChat uses OpenAI's language models — the same core technology behind ChatGPT — with additional guidance, safety layers, and parental controls built on top. Despite these measures, AI technology has fundamental limitations that every user and parent should understand:

• AI can produce inaccurate, incomplete, misleading, or inappropriate responses despite our safety measures. The model generates text based on statistical patterns, not factual understanding.
• AI does not possess judgment, intuition, or real-world understanding.It cannot truly "know" whether something is true, safe, or appropriate — it predicts what text should come next based on patterns in its training data.
• No automated safety system is perfect. Some concerning content may not be detected, and some safe content may be incorrectly flagged. Safety filters are probabilistic, not absolute.
• SapioChat is a tool to help guide AI conversations, not a guarantee of safe outcomes. We work continuously to improve safety, but we cannot and do not promise that every response will be appropriate for every child in every situation.
• AI should supplement — never replace — open family communication, professional guidance, or parental judgment.

Think of AI like a car: powerful and useful, but it needs a driver who knows how to steer. SapioChat provides the steering, but parents remain the ultimate safety net.

4. Not a Substitute for Professional Help

SapioChat is not a mental health service, medical provider, educational institution, or crisis hotline. While the AI is designed to respond safely to sensitive topics and direct users to appropriate resources, it is not a replacement for professional counseling, therapy, medical advice, educational services, or emergency services.

If you or your child is experiencing a mental health crisis, please contact:

Do not rely on SapioChat for time-sensitive, safety-critical, or life-threatening situations.

5. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• Parents are responsible for managing their children's accounts, reviewing safety settings, and monitoring flagged events.
• You agree to provide accurate, current, and complete information when creating accounts.
• You must be at least 18 years old to create a parent account.
• You must promptly notify us of any unauthorized use of your account.

6. Acceptable Use

You agree not to use SapioChat to:

• Generate content that is illegal, harmful, threatening, abusive, or promotes violence
• Attempt to circumvent, disable, or manipulate safety policies or content filters
• Use automated scripts, bots, or other programmatic means to interact with the Service
• Share account credentials with unauthorized individuals
• Use the Service for any commercial purpose other than personal family use
• Reverse-engineer, decompile, or attempt to extract the source code or underlying models of the Service
• Impersonate another person or misrepresent your relationship to a child

We reserve the right to suspend or terminate accounts that violate these provisions without prior notice.

7. Subscriptions and Billing

SapioChat offers free trials and paid subscription plans. Paid subscriptions are billed on a recurring basis (monthly or annually) through our payment processor, Stripe. By subscribing, you authorize Stripe to charge the payment method on file at the start of each billing cycle.

You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period, and you will retain access until that date. No prorated refunds are issued for partial billing periods. Refund requests for other circumstances are handled on a case-by-case basis — contact admin@sapiochat.com for assistance.

8. Account Termination and Deletion

To delete your account and all associated data, contact admin@sapiochat.com. Account deletion permanently removes all associated data including child profiles, conversations, safety events, and billing information. This action is irreversible.

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.

9. Limitation of Liability

To the maximum extent permitted by applicable law, SapioChat, its operators, affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to damages for loss of profits, data, goodwill, or other intangible losses — arising from or related to your use of, or inability to use, the Service.

Without limiting the foregoing, our total aggregate liability for all claims arising from or related to the Service shall not exceed the total amount you paid to SapioChat in the twelve (12) months immediately preceding the event giving rise to the claim.

You acknowledge that the AI-generated content provided through the Service is produced by automated systems with inherent limitations, and you assume all risk associated with reliance on such content.

10. Indemnification

You agree to indemnify, defend, and hold harmless SapioChat, its operators, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes via email at least 14 days before they take effect. Continued use of the Service after the effective date of updated Terms constitutes your acceptance of those changes. If you do not agree with the revised Terms, you must stop using the Service.
